Mladic requests that ICTY TC halt trial and replace two ‘biased’ judges: On 20 July 2016, lawyers for Ratko Mladic requested that his trial before the Hague Tribunal be halted due to fair trial concerns. The former Bosnian Serb Army commander is on trial for genocide and war crimes. The defence team for Mladic argued that judges Alphons Orie and Christoph Flugge should be removed from the trial and replaced as they ‘have previously made conclusions about Mladic’s guilt’ and as such are not able to be impartial. Objections were also raised by the defence in relation to the involvement of Theodor Meron, President of the Mechanism for International Criminal Tribunals, in Mladic’s appeal procedure due to statements made by Meron of Mladic’s guilt. In their motion to the court, the defence team also requested that a special UN Security Council working group be set up in order to determine whether Mladic’s fair trial rights and presumption of innocence have been jeopardised.
